In the U.S. it depends on which state you live in and what your state law are concerning this. There is no federal law concerning this issue as it is not mandatory for a company to give compensated vacation to it's employees. In some states it is dubious for companies to have a "use it or lose it policy".

Read your employee tourist information and see what the company policy is concerning payment for unused vacation days. They should enjoy something in there roughly paying you for them when you leave the company or not.

Yes. Your employer doesn't owe you pay packet for your unused vacation days, even if you accrued or earn them during employment. There's no law in the U.S. that states companies own to give you paid break.

It really depends on your State laws. In most states you must be paid your awarded time - which is different than your earn time. For example, a company can tell you that you earn 2 weeks of vacation respectively year, but they make it available to you at the end of your service year. At that point if you quit, you are probably owed the unused time. If you quit at the 11 month discoloration, you are not entitled to the time. In California, however, an employee is entitled to his/her accrue time regardless of the award schedule.

Paid Vacation Days is not a requirement for any employer. The fact that you had remunerated vacation was a privilege offered by that employer (and most do now).you didn't 'earn' it and the money is not yours for trade or reimbursement, especially since you enjoy left the company. Some people are below the misunderstanding they can save up vacation days and carry cash instead.in NO circumstances is the employer required to reimburse the hand. That's why "use it or lose it" policies were instated.

It depends on how your vacation time was calculated. If you accrue time as you went along (1.5 hours every week, .25 hours every day, for example), you must be salaried any accrued but unused time when you leave. Suarez vs. US Plastics, 1986, is the shield law if you are interested.

If, however, the policy was a "use it or lose it" plan where on earth you got all of yoru time off time for the year in one shot (40 hours every January 1st, for example), with the provision that you would forfeit unused time when you moved out, then the employer is not required to pay you.

Check your member of staff handbook and/or vacation policy next to the employer to see how it is written.

I am an accountant, not a legal or HR expert, but I am pretty sure that once an employer terminate you (or you quit), they have to pay you for your time off balance. This might vary depending on the law in your state. I would at least check beside the unemployment office surrounded by your area. That doesn't cost anything, and if they can't answer, they should at least be capable of direct you to a government office that can help out you.

By the way, if you have leave hours built up, you have "earned" them. Your employer doesn't just budge around paying people off the street to lug a vacation. It is part of what they money you for the work you did for them. Just like you earn your salary, condition benefits and pension.

Complex answer: depends on the employer and their policies...U can get it through unemployment if U want...Otherwise might hold to fight with your employer to acquire it back...
